Working with a Real Estate Licensee

The Owner Finance Marketplace is operated by Disposition Realty Partners, LLC ("DRP"), a Tennessee licensed real estate firm. Tennessee law (T.C.A. § 62-13-403 through § 62-13-405) requires every real estate licensee to provide a written disclosure of the agency relationship at the first substantive contact with a consumer. This page explains how that relationship works when you use this marketplace and engage DRP.

Tennessee is a default-disclosed agency state. Unless you sign a separate written agreement with us, DRP represents the seller of each listed property. Beyond that, every licensee owes every consumer a baseline of honesty, fair dealing, reasonable skill and care, and disclosure of known material facts about the property — regardless of who they represent.

What DRP does on this marketplace

DRP markets owner-financed homes at ownerfinancemarketplace.com on behalf of the individual property sellers. Each listing on this site is owned by a private seller who has engaged DRP as the listing brokerage. DRP is the seller's designated agent for marketing, qualifying buyer inquiries, negotiating offers, and facilitating the transaction through closing.

If you are a buyer using this marketplace

Without a written agreement with DRP

You're welcome to browse listings, submit the pre-qualification form, tour properties, and ask questions. In doing so, DRP is not your agent. We represent the seller of the listing you're inquiring about. We will be honest with you, disclose any material facts about the property that we are aware of, and treat you fairly — but our loyalty in the negotiation runs to the seller.

If you'd like DRP to represent you as a buyer

We can. To enter into a buyer-side representation relationship, you'll sign a written buyer representation agreement with DRP before we tour property with you. Under buyer representation, DRP owes you the same six standard fiduciary duties we owe sellers: loyalty, obedience to lawful instructions, full disclosure of material facts, confidentiality of personal and financial information, accounting for funds, and reasonable care.

As of August 17, 2024, federal settlement terms require a written buyer representation agreement before any real estate licensee can show a buyer property. This is a national requirement, not unique to DRP.

Working with an outside buyer's agent

You can also engage a separate brokerage as your buyer's agent and they can show you DRP-listed properties. In that case, your relationship is with that brokerage and DRP continues to represent the seller.

Confidentiality on this marketplace

When you fill out our pre-qualification form, contact us about a specific listing, or talk with our team on the phone, you may share information about your monthly budget, your down payment, your motivation to buy, your timeline, or your situation. Be aware:

  • If we are not your agent (the default), information about your willingness to negotiate, your urgency, your maximum budget, or anything that could weaken your negotiating position is information we may need to share with the seller we represent.
  • If we are your buyer-agent (under a signed agreement), that same information is confidential, and we will not share it with sellers.
  • Either way, your personal contact information (name, phone, email) is handled per our Privacy Policy and is not sold or shared with marketers.

If you have something sensitive to share — your bottom-line number, a personal circumstance affecting your offer — ask first whether the conversation is confidential. We will give you a clear answer.

Owner financing — what DRP is and isn't

DRP is a Tennessee licensed real estate firm. We market owner-financed listings, qualify buyer inquiries, negotiate offers, and facilitate closings through licensed Tennessee title companies.

DRP is not a bank, mortgage lender, mortgage broker, or mortgage loan originator and is not licensed under the Tennessee Residential Lending Act. Owner-finance terms — purchase price, down payment, monthly payment, interest rate, balloon (if any), prepayment terms — are negotiated between the buyer and the individual seller. All transactions close through licensed Tennessee title companies and are documented in standard recorded instruments (deed, promissory note, deed of trust). DRP does not extend credit, fund loans, or service notes.

Listing accuracy

Listing details on this site (square footage, bed/bath counts, lot size, sample terms, photos) are provided by the property seller or obtained from third-party data sources and are believed accurate but are not warranted. Buyers and their representatives should independently verify any fact material to their purchase decision. Owner-finance term examples shown on listing cards are typical or starting terms — actual terms in your contract may differ based on what you and the seller negotiate.

Dual agency

Tennessee permits dual agency (DRP representing both buyer and seller in the same transaction) only with the written informed consent of both parties. DRP avoids dual agency in most cases. If a dual agency situation arises, we will disclose it to both sides in writing and give you the option to engage separate representation.
